Terms and Conditions for RiteGiving

Welcome to RiteGiving (“we,” “us,” or “our”). By accessing or using RiteGiving.com, any of its subdomains, mobile applications, or services (collectively, the “Platform”), you (“User,” “Campaign Owner,” “Donor,” or “Visitor”) agree to comply with and be bound by these Terms and Conditions (“Terms”). Please read them carefully before using the Platform.
If you do not agree to these Terms, do not use our Platform.
1. Overview
RiteGiving is a crowdfunding platform that enables individuals, organizations, and groups to raise funds for various causes, projects, and personal or community initiatives. Users can create fundraising campaigns (“Campaigns”) and receive voluntary contributions (“Donations”) from supporters.
RiteGiving is not a bank, charity, financial institution, or payment processor. We provide the technology and tools to facilitate fundraising and donor engagement but do not directly handle funds.
2. Eligibility
By using RiteGiving, you confirm that:

You are at least 18 years old or have reached the legal age of majority in your country of residence.

You have the legal capacity to enter into a binding agreement.

You will use the Platform in compliance with all applicable laws and regulations.

You are not barred from using the Platform under any applicable jurisdiction.

If you are creating a Campaign on behalf of an organization, you are authorized to represent that organization.
3. Account Registration
To use certain features, you must create a RiteGiving account. When registering:

You must provide accurate, truthful, and complete information.

You are responsible for maintaining the confidentiality of your login credentials.

You are fully responsible for all activity under your account.
-
You agree to notify us immediately of any unauthorized access or use of your account.
We reserve the right to suspend or terminate any account that violates these Terms or is found to be fraudulent.
4. Campaign Creation and Management
When you create a Campaign on RiteGiving:

You must set a realistic fundraising goal, describe your cause truthfully, and upload accurate images or videos.

You agree that all content you post (text, media, or updates) complies with our Community Guidelines and applicable laws.

You are solely responsible for the use of funds raised.
-
You agree to use the funds only for the purpose stated in your campaign.
Prohibited Campaigns:
You may not raise funds for any of the following:

Illegal, fraudulent, or misleading activities.
-
Hate speech, violence, discrimination, or exploitation.
-
Drugs, weapons, or adult content.
-
Political or terrorist organizations.
-
Ponzi, pyramid, or get-rich-quick schemes.
-
Any other activity that violates the law or RiteGiving’s policies.
We reserve the right to remove or suspend any campaign that violates these rules or that we deem inappropriate.
5. Donations and Payment Processing
5.1 Donation Handling

Donations are voluntary contributions made by users to campaigns of their choice.

RiteGiving uses third-party payment processors (such as Stripe, PayPal, or local gateways) to collect and distribute funds.

We do not directly hold or control donations.

Donations may be subject to transaction fees, which will be disclosed at checkout.
5.2 Refund Policy

All donations are final and non-refundable, except in cases of proven fraud or where required by law.

Donors are encouraged to carefully review campaigns before contributing.
5.3 Payment Timing

Campaign Owners will receive donations after the payment processor clears and verifies them.

Transfer times may vary depending on the processor, bank, and country.
6. Platform Fees
RiteGiving charges a platform service fee on each donation to maintain and operate the Platform.
Additional payment processing fees may be applied by our third-party providers.
All fees will be clearly stated at the time of transaction. Fees are non-refundable.
7. Responsibilities of Campaign Owners
As a Campaign Owner, you agree to:

Use funds exclusively for the campaign’s described purpose.

Maintain transparency and provide truthful updates to donors.

Deliver promised rewards or acknowledgments, if applicable.

Comply with all tax, reporting, and legal obligations in your jurisdiction.

Refrain from making misleading claims or misusing donor funds.
Failure to comply may result in suspension, removal, or legal action.
8. Responsibilities of Donors
As a Donor, you acknowledge that:

You are donating voluntarily and understand RiteGiving does not guarantee campaign outcomes.

You are responsible for ensuring your payment details are accurate.

Donations are not tax-deductible unless stated otherwise by the Campaign Owner and confirmed by applicable law.
9. Prohibited Activities
Users may not:

Impersonate another person or entity.
-
Post false, deceptive, or defamatory information.
-
Interfere with the security or functionality of the Platform.
-
Upload viruses, malware, or harmful code.
-
Harvest data or scrape content from the Platform.

Use RiteGiving for money laundering, scams, or illegal transactions.
Violation of this section may result in permanent account suspension and potential legal action.
10. Content Ownership and License

You retain ownership of the content you upload (text, photos, videos).

By posting on RiteGiving, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and promote your content for marketing and operational purposes.

You confirm that you have the necessary rights to post any content you upload.
11. Privacy and Data Protection
Your privacy is important to us.

12. Taxes and Legal Compliance
Campaign Owners are responsible for determining and paying any applicable taxes related to funds received. RiteGiving does not provide legal or tax advice. Please consult a qualified professional for guidance.
13. Intellectual Property Rights
All content, trademarks, and materials on RiteGiving (including logos, text, design, and graphics) are owned by or licensed to RiteGiving and are protected by applicable copyright and trademark laws.
You may not use, copy, or distribute any part of the Platform without our prior written consent.
14. Suspension or Termination
We may suspend, restrict, or terminate your account or access to RiteGiving if:

You violate these Terms or our policies.

You engage in fraudulent or illegal behavior.

Required by law or regulatory order.
We reserve the right to delete any Campaign or Content without prior notice.
15. Disclaimer of Warranties
RiteGiving provides the Platform “as is” and “as available” without warranties of any kind, express or implied.
We do not guarantee:

That campaigns will reach their goals.

That funds will be used as promised by Campaign Owners.

Continuous, error-free, or secure access to the Platform.
Use of the Platform is at your own risk.
16. Limitation of Liability
To the fullest extent permitted by law, RiteGiving, its affiliates, officers, and employees shall not be liable for any:

Loss of data, revenue, or profits.

Misuse of funds by campaign creators.

Errors, downtime, or service interruptions.
-
Indirect, consequential, or incidental damages.
Our total liability shall not exceed the total amount of fees you paid to us in the 3 months preceding the claim.
17. Indemnification
You agree to indemnify, defend, and hold harmless RiteGiving and its affiliates from any claims, damages, losses, or expenses arising from your:

Use of the Platform.

Violation of these Terms or applicable law.

Posted content or campaigns.
18. Modifications to Terms
We may update or modify these Terms at any time.
Changes will take effect upon posting on the Platform, with the “Last Updated” date reflecting the change.
Your continued use of RiteGiving after any update constitutes acceptance of the revised Terms.
19. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Jamaica, without regard to conflict of law principles.
Any disputes shall be subject to the exclusive jurisdiction of the courts located in Jamaica.
